This link to one of the fansites shows all of the spells for the Death School:
On that link, you can click on the blue highlighted items to see what you may have missed ("prequest", requirements, etc.). I'm not sure what you mean by the Level 78 pet. There is nothing listed for Level 78.
But if you scroll down to "Scarecrow", you can see the "Quest Line" that you need.
And don't forget to pick up your free spells from the Other Trainers too.

The scarecrow pet is from quests in Wintertusk and is not given by Dworgyn. All Death spells are below and all have prequests which, my guess is, you are missing... the scarecrow pet quest is below this link:
What was the last pet you got? You need to do all pet quests in order. My guess is that you skipped Grizzleheim/Wintertusk. In order to get your pet at level 58 you need to complete Grizzleheim and Wintertusk up through http://www.wizard101central.com/wiki/Quest:Nordrilund_Exposure
